MINERAL ADMINISTRATION REGISTRY SASKATCHEWAN TERMS AND CONDITIONS OF USE

Mineral Administration Registry Saskatchewan ("MARS") website including the MARS Home Page and other MARS content (collectively the "MARS website") is provided on the basis that registered clients agree to the terms and conditions set out below. These Terms and Conditions of Use may be amended by the Government of Saskatchewan ("GOS") from time to time. Continued use of the MARS website following the posting of revised Terms and Conditions of Use constitutes acceptance of the amendments and registered clients agree that they shall be bound by such changes.

TRADEMARKS AND COPYRIGHT

All content contained on the MARS website, including (without limitation) website design, text, graphics, the selection and arrangement thereof and all software are copyright © Government of Saskatchewan.

Reproduction of any materials for commercial purposes requires the advance written permission of the Government of Saskatchewan. Requests for copyright permission must be directed to the Office of the King's Printer for Saskatchewan, Ministry of Justice, by emailing [email protected].

Permission is granted to electronically copy or to print in hard copy portions of the MARS website solely for acquiring or otherwise managing a Crown mineral disposition or using the MARS website as a non-commercial information or registration resource. Any other use of materials on the MARS website, including reproduction for purposes other than those noted above, modification, distribution, posting or republication (including a website, online service, private or public intranet, and local or wide area network) or storage in an electronic retrieval system without the prior written permission of GOS is strictly prohibited.

Certain graphic images including the website banners, the Coat of Arms and stylized wheat sheaf are Government logos and emblematic of the Saskatchewan Government. These images may not be reproduced on non-Government materials without the written permission of Brand Management, Executive Council, Government of Saskatchewan. All other trademarks, product names and company names or logos appearing on the MARS website are the property of their respective owners.

DISCLAIMER AND LIMITATION OF LIABILITY

GOS provides the MARS website and any information, material, documents or services available through the MARS website on an "AS IS, WHERE IS" and "AS AVAILABLE" basis and makes no representations or warranties, either express or implied, of any kind, with respect to the MARS website or its contents. The MARS website is subject to change and may be incomplete or no longer current.

In no event shall GOS be liable for any damages including (without limitation) direct, indirect, special or consequential damages, loss of data, income, or profit, loss of or damage to property or claims of third parties arising from or relating to access to, use of, reliance upon or inability to access or use the MARS website or any information, materials, documents or services available on or through the MARS website or any hyperlinked site. Registered clients are responsible for independently verifying information obtained through the MARS website.

The MARS website, and its related mapping application, uses geomatics information provided by other suppliers in addition to geomatics information created and maintained by GOS. GOS provides no endorsement, representation or warranty of any kind regarding third-party geomatics information, and the registered client, to the fullest extent permitted by law, hereby waives any claim against GOS with respect to accuracy, completeness, currency or validity of such information.

The MARS website may contain links to other websites over which GOS has no control. GOS provides no endorsement, representation or warranty of any kind regarding the products, services, content, accuracy or appropriateness of such websites, and the registered client acknowledges that GOS shall not be liable with respect to such websites.

The MARS website requires registered clients to maintain up-to-date contact information including an active email account for the delivery of electronic notices issued by GOS. GOS disclaims any and all liability and responsibility for the maintenance of this contact information together with any damages of any kind arising from the failure of the registered client to receive electronic legal notices from GOS owing to incomplete, inaccurate or out of date contact information.

GOS disclaims any and all liability and responsibility for any unauthorized use or misuse of a registered client's account number, password, access code or similar security tool and any loss or damage arising out of or in connection with such unauthorized use or misuse shall be the sole responsibility of the registered client. Registered clients shall immediately notify GOS of any suspected unauthorized access to or use/misuse of their account credentials.

Price and availability of information, timing, material, documents or services from the MARS website and services offered are subject to change without notice.

GOS does not warrant that the MARS website will operate uninterrupted, error-free, secure or free from viruses, malware or other harmful components.

PRIVACY

Collection, Use and Disclosure of Personal Information

The Ministry of Energy and Resources (the "Ministry") collects, uses and discloses personal information through the MARS website for the purpose of administering mineral dispositions, maintaining the mineral tenure registry, processing registrations and transactions, and providing related services. Personal information is collected, used and disclosed in accordance with applicable Saskatchewan legislation, including The Freedom of Information and Protection of Privacy Act (FOIP).

Personal information collected through MARS may include, where applicable:


  • name;
  • business or mailing address;
  • telephone number;
  • email address;
  • account information; and
  • any additional information reasonably required to administer MARS services.

Personal information will only be used or disclosed:

  • for the purpose for which it was collected or a use consistent with that purpose; or,
  • as authorized or required by applicable legislation, including FOIP and governing mineral tenure legislation.

The Ministry takes reasonable measures to protect personal information and limits access to authorized personnel who require the information to perform their duties. This information is maintained in a secure environment and protected through administrative, technical and physical safeguards.

Automatic Collection of Technical Information

When you visit or use the MARS website, the system may automatically collect limited technical information required for the operation, security and administration of the service.

This information may include:


  • the date and time of access;
  • Internet Protocol (IP) address;
  • browser type and version;
  • operating system information;
  • pages visited; and
  • other technical information required for system administration and security monitoring.

This information is collected to maintain service integrity, diagnose technical issues, evaluate system performance, identify security threats and improve service delivery. Technical information is not used to identify individual users except where necessary to investigate suspected unauthorized activity or as otherwise authorized by law or to comply with legal, regulatory or audit requirements.



Cookies


The MARS website uses cookies to support system functionality and improve user experience.


Cookies may be used to:


  • maintain authenticated user sessions;
  • remember selected user preferences;
  • improve system performance; and
  • collect aggregate statistical information regarding system usage.

The optional "Remember Username" feature uses a persistent cookie stored on the user's device. This cookie remains on the device until deleted by the user, browser settings or device management controls.

A separate session cookie is generated after a user signs into the MARS website and is used only to maintain communication between the user and the application during the active session. The session cookie is removed when the browser session ends.

Cookies are used solely to support the operation, administration and security of the MARS website. Users may modify browser settings to disable or restrict cookies, however, doing so may affect the functionality of the MARS website.

The MARS website is monitored for operational, security and administrative purposes. Information obtained through such monitoring may be used to investigate suspected misuse, unauthorized activity or violations of law and may be disclosed or used in legal, regulatory, administrative or disciplinary proceedings.

Public Registry Information

MARS operates as a public mineral tenure registry. Information associated with mineral dispositions, ownership interests, transfers, registrations and other registry transactions is maintained as part of the public mineral tenure registry and may be made available for public inspection, search or retrieval in accordance with applicable legislation governing mineral tenure administration.

By submitting applications, registrations or other transactions through the MARS website, users acknowledge that information required to be maintained in the public registry may be disclosed and made publicly available in accordance with applicable law.

Personal information collected for account administration and system access purposes is not publicly available unless it forms part of information required to be maintained in the public mineral tenure registry, or disclosure is otherwise authorized or required by law. Where a client is an individual, their name may appear in registry records for mineral tenure administration. Personal contact information, including residential address, email address and telephone number, is not publicly displayed.

GOVERNING LAW AND JURISDICTION

By using the MARS website, the registered client agrees and submits to the jurisdiction of the courts of the Province of Saskatchewan, Canada and to the application of the laws of the Province of Saskatchewan, Canada, without respect to choice of law principles.

The provisions of these Terms and Conditions of Use constitute the entire agreement between you and GOS and supersede all previous communications, representations and agreements, whether oral, written or electronic, between the parties with respect to the subject matter herein. There are no representations, warranties, terms, conditions, undertakings or collateral agreements (express, implied or statutory) between the parties other than as expressly set forth in these Terms and Conditions of Use.

By accepting these Terms and Conditions of Use, you acknowledge that you have the authority and capacity to do so.
